Texas Supreme Court Justice Violates Texas Judicial Code of Conduct With Campaign Ad

I saw this ad yesterday on Facebook, and was sickened by the idea that a judicial candidate would stoop to this:

Willett is a Justice on the Texas Supreme Court, which is the highest civil court in Texas.

The Judicial Code of Conduct seeks to preserve the integrity of the justice system in Texas by holding judges and justices to a higher standard of conduct and impartiality.

From the Judicial Code of Conduct, Canon 5:

CANON 5
Refraining From Inappropriate Political Activity

(1) A judge or judicial candidate shall not:
(i) make pledges or promises of conduct in office regarding pending or impending cases, specific classes of cases, specific classes of litigants, or specific propositions of law that would suggest to a reasonable person that the judge is predisposed to a probable decision in cases within the scope of the pledge;


So there he is selling himself for re-election based on the outcome of a case that is still being litigated, and portions of which may continue to be litigated in the future, depending on the outcome in the U.S. Supreme Court.

I really dislike the notion that we need partisan judges who sell their positions on given topics rather than their general qualifications or philosophy. It is a shame that the last branch of government that had any integrity or appearance of integrity is slowly allowing itself to sink to this level.

I hope the Texas Commission on Judicial Conduct will investigate Willett's campaign and make this Justice comply with the the law.

Absolutely agree - this is shameful and concerning. I may want to see this repealed, but I want this done by judges with open minds – not by judges by with a ruling already in mind before the case starts. Judges, by nature of their position, should be neutral heading into a case. They should be free of bias and judge a case based on the facts presented during trial. Stating they will rule one way or another without hearing the facts of the case is wholly and completely inappropriate.

That being said, I’m not sure I buy this is an ad paid for and approved by Judge Willett. With this in mind, I just sent off an email (http://www.donwillett.com/contact) asking for clarification. I’ll post back if/when I get an answer. Below is the content of my email.

Justice Willett -

As a conservative, my biggest concern is impartiality on the bench. I hate to think any judge has made up his/her mind about a case before hearing the case in its entirety. With this in mind, I came across what was appeared to be a Facebook ad for your campaign. The text stated 'Help re-elect the court's Antidote to ObamaCare'.

Is this indeed an official approved ad for your campaign?

The quote "antidote to Obamacare" comes from Michael Quinn Sullivan, leader of the "not lobbyist" anti-public education group Empower Texans. Willett includes it prominently on his Endorsements page. He also tweeted this:

Someone asked about this on his Facebook page back in February, asking:

If you have an ad on Facebook saying that you're the cure for Obamacare why would I think you have an open mind about anything? Aren't judges supposed to be impartial. You have already proved you are not just with one ad.


Justice Willett's answer was:

Hi, Kelly. I don't self-describe as "the judicial antidote to ObamaCare," but several conservative leaders across Texas and the nation describe my judicial philosophy that way, which is why the phrase is contained within quotation marks.


So the quotes, along with the words "described as", means that it's okay. I guess.

The canon quoted above appears to apply to "cases within the scope of the pledge" which I imagine is a way of saying that it only applies to issues that might come before the court to which a judicial candidate is seeking election. So is there any plausible way that the issue of whether federal health care legislation violates the federal constitution would be an issue in a case that comes before the Texas Supreme Court? Maybe but it seems like a stretch. But that is actually the problem - it implies that a Texas Supreme Court justice can have some impact on federal healthcare legislation and therefore you should bring your Obamacare frustration with you when you vote for that office. But I don't think that's the case - the Texas Supreme Court is highly unlikely to ever have any impact on anything related to Obamacare. So the ad may not violate the cannon but only because it's arguably misleading since it implies that the Texas Supreme Court has some say in the matter.

I see what you are saying. Not sure how he can be the 'antidote to Obamacare' if he is not likely to have any influence on the issue. But if he was likely to have influence, this should not be part of his campaign.

So, next time I run for school board I can use ‘Your #1 choice to make Steve America’s next Top Model’? Basically, a hot button item that everyone I know is for but something in which I am likely to have no influence?
