LISD Board Leaves Seat Open, Approves Publication of Proposed Budget

Open in new windowI'll have video and more in-depth coverage later, but I wanted to post a very quick recap of tonight's LISD Board meeting, and get some budget documents out there for the public to see.

Knapp's Seat to Remain Open
First, the LISD Board considered action on filling the seat left vacant by Jeff Knapp's resignation. In an ironic vote that proved the need for 7 trustees, the board had two tie votes 3-3 on two alternatives for the seat. Trustees Mike McDaniel and Brenda Latham were strongly in favor of leaving the seat open, with Latham saying that the board could handle the absence, and that it would be a sort of team-building experience. New trustee Trisha Sheffield was on the fence. Trustees Julie Foughty and Kathy Duke were in favor of filling the position, but only with a very good and non-controversial candidate.

Trustees went into closed session to discuss who the possible candidates would be. Former trustees Tom Ferguson and Amber Fulton were in attendance. When the trustees came out, they voted on the motion by McDaniel to keep the seat open until next May. That vote resulted in a 3-3 tie, with McDaniel, Latham, and Sheffield voting for, Duke, Foughty, and Kyer against. On a motion by Julie Foughty to appoint Ferguson, the board again split 3-3 on the same lines, with Foughty, Duke, and Kyer voting for.

When that vote failed, Latham motioned to reconsider leaving the seat open until May. On that vote, Kyer relented, allowing the vote to pass. The seat will be vacant until next May, but nothing prevents the trustees from coming back later to fill the position.

Budget
Trustees voted to approve the publication of a proposed budget and tax rate, and set a public hearing for August 27th, at which time the budget and tax rate will be voted on.

The budget documents will be attached to this story so the public can review them. The maintenance and operations tax rate will remain the same next year at $1.04 per $100 property valuation, and the Interest and Sinking Fund (I&S) rate used to pay for construction debt will increase very slightly from 38.6 to 41.3 cents per $100 valuation, which is still 2 cents below the rate promised in the authorizing bond election. The district floated additional bonds this year, which will need to be repaid beginning in the 2012/13 school year. This puts the total rate at $1.453 per $100 valuation, or about $1,453 for a $100,000 home.

Even though the total tax rate is slightly increased, the district will see a total decrease in revenue of $9.1 million under 2011/12 due to continued decreases in state funding.

There is a budgeted shortfall of $23 million in the coming year, which would be taken from the reserves fund balance. The fund balance projected for September 1st is $128 million. In reality, the actual deficit is often smaller, but is usually over-stated due to conservative accounting practices.

The district expects to finish up the 2011/12 school year by tapping the reserves for last year's deficit of $5.3 million, compared to the $17.5 million originally forecast.

Strikes me as two attempts at a power play, only with both sides equally matched. The idea that the seat needs to remain open has to be the ultimate irony given what had just happened because the seat was open. Like a family of six agreeing on where to eat, only far less functional on a far more important decision.

I didn't attend the meeting or watch any video, but I'm glad Tricia Sheffield is not automatically voting with Kyer. Sheffield's independence is a pleasant surprise to me. During the election, I thought she seemed very nice, but I was afraid that she would tow the Kyer line on important decisions. This vote shows that her vote is HER vote, and I am now happy that she is on the Board.

It sounded to me more like an agreement to work together and come to a consesus rather than a power struggle. I think this could be just the thing that could make this board a stronger board. The district definately appears to be headed in a positive direction.

It is great to come to a consensus decision, but this is a non-decision. This deliberation shows weak leadership backed up by hollow reasons to justify no action. The board has seven positions for many reasons. Make no mistake, this was a successful power play by two board members who can no longer direct the agenda since Ms Gregg and Mr Knapp are no longer on the board. Instead they decide to derail the process of appointing a replacement for Mr Knapp. Shame on this board for showing such poor leadership and being manipulated into no action.

I think just the opposite. I think the board came together and worked out a short-term solution to a short–term issue.

Where in recent board decisions do you see that the board, which Mr. Knapp and Ms. Gregg were members of, directed any agenda?

As for 'derailing the process of appointing a replacement for Mr. Knapp', the board was not meeting to appoint a replacement. They were meeting to, as per the posted agenda, “Consider Options to Fill Unexpired Term of Board Member who Moved out of District”. Under TEC code the options were to fill the position with a special election, appoint a member to finish out the term or due to short time left on the position, leave the position open. They considered the options, met among themselves and came up with a short-term solution; one that did not cause conflict or worse yet, cost the district money – money we need for our district.

Again, I ask, where is an specific recent example (with Knapp and Gregg) of the board driving the agenda?? I know in the past, the board did exactly what they wanted without listening to any community input, but that seems to have gotten better.

Someone stated that only 2 people wanted Mr. Knapp's position left open, yet after some discussion, the vote passed. LISD, until recently, was infamous for rubber stamping everything. I think it's a pleasant change to see them have some discussion before voting on an issue.

I am having a hard time understanding why it is so important to fill a seat when there is only 9 months left? Do we think that this board cannot make a decision without a 7th person?

Your argument makes no sense and you are obviously a mouthpiece for someone on the board. Did the previous board drive the agenda or did they rubber stamp everything that came down? It can't be both. The citizens and taxpayers of LISD deserve full representation. There is a lawsuit against the state and a 2013 legislative session looming. Full representation on this board is essential and any argument for leaving it open stems from political expediency and nothing else.

What?? NO I’m not a “mouthpiece” for any board member. From what I have heard and seen they really don’t need mouthpieces. They seem like they can speak for themselves, as they did this week. Just because people don’t agree does not make someone a mouthpiece. We have different opinions. Nothing more – no great conspiracy. I just don’t think we should spend money for a special election with approximately 9 months left on the term.

The PREVIOUS board (before the Knapp, Latham, and Foughty election) was a rubber-stamping board. Look at any of the minutes from before 2010 and all you will see is across the board approvals, even when, financially, some decisions were not the best for LISD.

I asked for examples of RECENT board driven agendas, when Knapp and Gregg were on the board. I am curious to see if this is indeed the case.

It is actually better to have the seat filled because decisions can be made without constant ties. It didn't have to be done with an election. The board could have filled the position for the 9 month period with no money expended.

If we start having constant ties with this six member board, then I have to think that the administration will not be doing its job very well. If a recommended course of action is not strong enough to pursuade four out of six board members, then we should probably NOT take that course of action. Perhaps this dynamic will ensure that the administration will fully investigate and consider its actions BEFORE implementing its plans. Thank goodness for the willingness of some of the current Board members to ask the tough questions!

When the three-three ties kept coming, Kyer switched and voted to leave it open. What is wrong with taking applicants and filling this position through interviews? I never saw that discussed on the video. Besides a special election, this is the most fair and equitable way to proceed. No one will convince me that leaving this position open is the right decision. Furthermore it is an abdication of the board's responsibility to the taxpayers of this district to leave it open.

Agrees with you!!!! If there are constant ties, we have other issues besides an open seat on the School Board.

If that is true, why are most boards set up in odd numbers? The answer is to prevent the occurrence of a tie. OR the president, mayor, etc. don't get a vote unless there is a tie. There actually is a reason to fill the seat. Ties do happen especially if the board is divided in other ways. Having an odd number of people on the board had a specific intent. There are important issues coming before this board and I would rather have an extra head in the game than not. I don't have an agenda regarding who should be appointed but it needs to be taken care of by the board immediately. Just appoint someone! Nine months is almost a third of someone's term on the board so you can't tell me it doesn't matter.

Even if we have some 3-3 tie votes the future, it will be far better than giving the deciding vote to some who is not an elected board member.

You ELECTED the 6 people on the board to do the business of the board. If there is an empty position on the board, you should trust that your ELECTED board would work together to fill the position. The cost of an election just for this slot is prohibitive but I don't think it should be left vacant. The school district deserves 7 people representing it.

LISD SCHOOL BOARD: DO YOUR JOB AND FILL THE VACANT POSITION!

Have to agree with fill the position that the position needs to be filled. Considering nobody is talking about the new pay scale. new employees and with limited experience raked in nice pay raises. The top at Central Administration, Zone Leaders and Principals raked in nice pay raises and had their wage capped set high. Those with experience AKA Age who are good, dedicated employees (teachers, etc), who are training the least experienced had their pay frozen and wage caps set low to force them out. Talking about low morale and also isn't this age discrimination?
This is the board that is weak. Carol Kyer and her position has always been for the good of the good of the district (staff and students). It's sad that the trend in Lewisville is now to get ride of anybody with experience because they are too old and cost too much, when the people are good employees and love their work.

... but this may be the first time I've ever seen two divisive groups disagree over whether divisiveness is divisive (or productive) or not. Or something.

Folks, no matter what the board did, at least 50% of you would be complaining about it on here. The electorate is clearly divided, as indicated by your comments. So the board, which is elected to represent the electorate, is also divided.

In other words, they represent you, you can't get along, so they can't get along. You all got what you deserved.

Find some kind of compromise, agree on it (oh you post anonymously? Guess it's kind of hard to include you in the process, isn't it?) and if every one of you folks shows up to the next meeting with a general consensus, I guarantee you they'll vote that way. Before you whine out some kind of "we've done that but we've always been ignored" reply, let me retort: DO IT AGAIN.
